Focus on LAW

David M. Anthony concentrates his practice in the areas of bankruptcy, commercial litigation, creditor’s rights, construction and lien litigation. Mr. Anthony represents clients throughout middle Tennessee in state, federal, and bankruptcy courts. He also has significant experience representing financial institutions and other creditors in all aspects of the litigation process. 

Mr. Anthony is a regular author and guest speaker on topics related to bankruptcy, post-judgment collections strategy, foreclosures, ethics and trial practice.

He received his B.A., summa cum laude, from the University of Memphis in 1996 and his J.D., cum laude, from the University of Tennessee College of Law in 1999. At the University of Tennessee, Mr. Anthony was the recipient of the Matthews-Jeter Academic Scholarship and a Certificate of Academic Excellence in Law and Medicine Seminar. He also participated on the Jessup International Law Moot Court Team and in the 1999 James Baker Hughes Writing Competition of the Houston Journal of International Law.

Mr. Anthony is a member of the Tennessee, Nashville and American Bar Associations and is admitted to practice before all Tennessee state courts and the District Court for the Middle District of Tennessee.  He is also an active member of the American Bankruptcy Institute.

Representative Cases

  • Representation of national and regional banks and creditors in commercial litigation, collections, and other related litigation.
  • Enforcement of bond claims and materialmen's lien claims on behalf of general contractors, subcontractors, and material suppliers on commercial and residential construction projects throughout Tennessee.  
  • Representation of lenders in commercial and consumer foreclosure actions, including workout and forbearance agreements, judicial foreclosures, and detainer actions.
  • Representation of bankruptcy trustees in fraudulent conveyance and preference avoidance actions, and served as local co-counsel for Liquidating Trustee in large Middle Tennessee Bankruptcy case involving the prosecution and management of more than 280 preference actions, totaling over $75 million in dispute.
  • Representation of preference defendants in numerous bankruptcy matters.
  • General representation of creditors, suppliers, and trustees in all levels of bankruptcy proceedings, including critical vendor and reclamation claims, automatic stay relief motions, discharge and dischargeability actions, and litigation regarding confirmation of plans of reorganization.
