David M. Anthony concentrates his practice in the areas of bankruptcy, commercial litigation, creditors’ rights, construction and lien litigation. Experienced in Tennessee debt collection and Tennessee collection laws, David represents creditor clients throughout Middle Tennessee in state, federal and bankruptcy courts. He also has significant experience representing financial institutions throughout the loan transaction process, including loan documentation and renewals, as well as loan re-works and reorganizations.

David is a regular author and guest speaker on topics related to bankruptcy, post-judgment collections strategy, foreclosures, ethics and trial practice. A well-renowned Nashville bankruptcy attorney, David also maintains and publishes a blog, CreditorsRights101.com, and corresponding Twitter feed (@creditorlaw), both of which focus on creditor issues in the law.

David says his favorite part about being a lawyer (besides helping his clients, of course), is the thrill of victory, whether it’s after a hearing or just working out an agreed resolution. “The sense of accomplishment and justification of your hard work is the closest thing I can imagine to how a professional athlete feels after a big game,” he says.

• Representation of national and regional banks and creditors in commercial litigation, collections and other related litigation.

• Enforcement of bond claims and materialmen’s lien claims on behalf of general contractors, subcontractors and material suppliers on commercial and residential construction projects throughout Tennessee.

• Representation of lenders in actions related to commercial and consumer Tennessee foreclosures and Nashville foreclosures, including loan workout and forbearance agreements, judicial foreclosures and detainer actions.

• Representation of bankruptcy trustees in fraudulent conveyance and preference avoidance actions. David served as local co-counsel for Liquidating Trustee in a large Middle Tennessee Bankruptcy case involving the prosecution and management of more than 280 preference actions, totaling more than $75 million in dispute.

• Representation of preference defendants in numerous bankruptcy matters.

• General representation of creditors, suppliers and trustees in all levels of bankruptcy proceedings, including critical vendor and reclamation claims, automatic stay relief motions, discharge and dischargeability actions and litigation regarding confirmation of plans of reorganization.
